Description of Service Whispero is an iOS application that generates personalized bedtime stories for children using artificial intelligence technology. The App offers: - AI-powered story generation from user prompts - Text-to-speech audio narration - Local story library storage - Customizable reading experiences 3. Eligibility The App is intended for use by: - Parents and guardians aged 18 years or older - Families with children who enjoy bedtime stories - Users must have a compatible iOS device (iOS 18.0 or later) By using the App, you represent that you are at least 18 years old or have parental/guardian consent. 4. License Grant Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to: - Download and install the App on your personal iOS device(s) - Use the App for personal, non-commercial purposes - Generate and store stories for family use 5. Trial Period and Purchases 5.1 Free Trial - New users receive a 7-day free trial period - Trial allows generation of up to 3 stories - Trial status is managed locally on your device - No payment required during trial period - Cancel anytime before trial ends to avoid charges 5.2 Lifetime Unlock (One-Time Purchase) - Available for devices with Apple Intelligence support (iOS 18.1+) - One-time payment for unlimited story generation - Stories generated on-device using Apple Foundation Models - No recurring charges - Non-refundable except as required by law 5.3 Monthly Subscription - Available for devices without Apple Intelligence support - Recurring monthly charge for unlimited story generation - Stories generated using OpenAI API - Auto-renews unless cancelled 24 hours before period ends - Managed through your Apple ID account - Cancel anytime through App Store settings 5.4 Payment Processing - All purchases processed through Apple's App Store - Subject to Apple's Terms of Service - Prices displayed in your local currency - Prices subject to change with notice 6. Third-Party Services 9.1 OpenAI API - Some devices use OpenAI's API for story generation - OpenAI's Terms of Use apply: https://openai.com/policies/terms-of-use - We are not responsible for OpenAI service availability or quality - Service interruptions may occur due to third-party dependencies 9.2 Apple Services - App Store purchases governed by Apple's Terms and Conditions - Text-to-speech uses Apple's AVFoundation framework - StoreKit manages purchase verification 10. Intellectual Property 10.1 App Ownership - The App, including all code, design, and features, is owned by APP DEV MASTERS LTD - Protected by copyright, trademark, and other intellectual property laws - "Whispero" name and logo are trademarks of APP DEV MASTERS LTD 10.2 Limited License - You receive only the limited license described in Section 4 - No transfer of ownership or intellectual property rights - All rights not expressly granted are reserved 11. Disclaimer of Warranties THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Merchantability or fitness for a particular purpose - Uninterrupted or error-free operation - Accuracy or reliability of generated content - Compatibility with all devices or iOS versions - Availability of third-party services (OpenAI API) 13.
